A lawsuit filed by a fisherman who says he was attacked by a shark in the ocean is going to the United States Supreme Court.
The suit, filed by Michael J. Fitch in San Diego, says he’s not the first person who’s been attacked by the blacktip shark.
In May 2014, Fitch said he was fishing near the San Francisco Bay with friends when he came across a shark about two to three feet long.
Fitching said he thought it was a great white, and he didn’t want to get too close.
“He came right up behind me, he came right down the middle of me,” Fitch told The Associated Press.
“I jumped up, I grabbed my bow and gun, and I went down.

The lawsuit, filed in San Francisco Superior Court, says Fitch did not intend to injure anyone and that he’s been treated and released from the hospital.”
We’re asking the court to allow him to return to fishing as soon as possible,” said his attorney, Paul Taggart.
Taggart said the attorney general’s office is considering whether to file a motion for summary judgment, which means the lawsuit could be dismissed if Fitch is found not liable for the attack.
The suit was filed last year, and Taggert said he plans to file an amicus brief on the matter.”
